The Presidential Memorandum on “Expanding Capabilities To Combat Transnational Cyber-Enabled Crime,” issued on August 12, addressed how the government intends to increase private sector engagement in U.S. cyber defense. The Memorandum, for the first time in U.S. history, establishes a program for private companies to conduct cyber surveillance operations and cyber effects operations under DOJ and DHS oversight, building on President Trump’s March 2026 Executive Order addressing cybercrime and fraud.
